A BILL to amend and reenact article eight, chapter seven of the
code of West Virginia, one thousand nine hundred thirty-one,
as amended, relating to requiring persons incarcerated in
county or regional jails to pay for the costs of incarceration
for the first five days; and providing for reimbursement of
same when the person so incarcerated is ultimately acquitted
of the charges that resulted in the incarceration.
Be it enacted by the Legislature of West Virginia:

That article eight, chapter seven of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended and reenacted to read as follows:
ARTICLE 8. JAIL AND JAILER.
§7-8-13. Reimbursement for costs of initial incarceration.




Notwithstanding any other provision of this code to the contrary, any person who is arrested and incarcerated in a county
or regional jail shall pay to the county commission the actual
costs incurred for the first five days of incarceration: Provided,
That if a person is ultimately acquitted of the charges which
resulted in the incarceration, the county commission shall
reimburse the costs for incarceration paid to it by that person.




NOTE: The purpose of this bill is to require that persons
incarcerated in county or regional jails reimburse the county for
the costs incurred for the first five days of incarceration.
